RECREATIONAL DEALER SOLUTIONS, LLC (“ZiiDMS”, “we”, “us” or “our”) is committed to protecting your privacy through compliance with this Privacy Policy. We provide this Privacy Policy to explain our practices relating to our collection, use, disclosure and protection of your personal information. This Privacy Policy applies to dx1app.com, ziidms.com, and any of our other websites or mobile applications that direct to this policy.

We collect your personal information when you choose to provide it to us in connection with your use of our websites or apps.  For example, if you schedule a demo or submit a support request, we will ask you for personal information relevant to such requests, such as your name, zip code or location, the dealership you work for or represent, your email and phone number, and any details regarding your request.

In addition to the information you give us directly, we collect certain information automatically as you use our services.  We generally use cookies and other tracking technologies to collect this data.  For example, we may automatically collect your IP address, browser or device model and settings, operating system information, or other information regarding how you use our websites or apps.  This aggregated information provides statistics that we use to analyze, market and improve our website, services and business.  You can the security settings on your computer or mobile device and reset your browser to approve or reject cookies on a case-by-case basis, block cookies from certain sites, or even refuse all cookies.

Use of Personal Information

We use your information to provide our services to you, such as responding to your request for a demonstration of our services or assisting you with any support request, and to share with you other services we think you may be interested in.  We may use the information we gather regarding your use of our websites or apps research, develop, manage, protect and improve our websites, apps or services. 

We also use your information to detect, investigate, and prevent fraudulent transactions and other illegal activities, to enforce our Terms of Use and other agreements with you, and to protect the rights and property of ZiiDMS and its affiliates, its customers, and others.

We may disclose your information to our affiliates and partners in the provision of our services, to protect the security and integrity of our website and mobile applications, to correct technical problems and malfunctions on our website, mobile applications or software, to technically process your information, or to take precautions against liability.  We also may provide your information to vendors who provide services on our behalf, to your company or organization if you use our services under a corporate or other commercial account, or to debt collection agencies if you fail to pay monies owed to us.  

If ZiiDMS is involved in a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation, information about our website and app users may be among the assets transferred. In addition, we may disclose your information for the purpose of evaluating and or/performing any such proposed transaction. We may also disclose any information as needed if that information is requested by law enforcement agencies or if we are required to do so by law, treaty, regulation, subpoena, court order, or by a government entity. In addition, we may disclose your information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating our Terms of Use.

Our website and apps are intended for a general audience and were not designed for children, and we are not responsible for any access or use of our services by children. If you are under 18, you may use our websites and apps only with the involvement of a parent or guardian.

California Privacy Rights

CCPA

If you are a California resident, you may have additional privacy rights under the California Consumer Privacy Act (“CCPA”) and other California privacy laws. ZiiDMS provides dealer management systems and other solutions to a variety of powersports dealers. As a service provider to those dealers, we only collect and use personal information of each dealer’s customers as authorized by the dealer in our written contract for the services provided. If you are a customer of one or more of our dealers and would like to exercise your privacy rights under the CCPA, please contact the dealership(s) with whom you have relationships. The dealership can verify your identify and assist you with processing your privacy request. 

Do Not Track

Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites and online services that you do not want to be tracked. Because there is not yet an accepted standard for how to respond to a DNT signal, we do not currently respond to DNT signals on our websites.

Data Security

We have in place what we believe to be commercially reasonable physical, electronic and managerial procedures to safeguard and help prevent unauthorized access of, maintain data security for and correctly use the personal information you have provided or that we otherwise collect through our services. However, while such efforts are intended to ensure the confidentiality of your personal information available to us as a result of your use of the services, we cannot and do not warrant or guarantee the absolute safety and security of your personal information.  It is important for you to follow standard privacy protection practices, such as securing any username and passwords, changing your passwords often and selecting strong passwords that include a combination of letters and numbers, and generally protecting against unauthorized access to your computer, mobile device and any access credentials.

If you become a member of our website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device, and you agree to and accept sole responsibility for any and all activities that occur under your account or password. You also agree to notify us immediately of any unauthorized use of your account or password, or any other breach of security.

ZiiDMS is based in the United States and the information we collect is governed primarily by U.S. law. Where we are subject to the privacy laws of other countries, we comply with those requirements. If you access or use our services or provide information to us, your information will be processed and stored in the United States, where you may not have the same rights and protections as you do under your local law.

Our sites or apps may contain links to third party websites, which links are provided solely for your convenience. ZiiDMS does not control or endorse any such third party website, and cannot be responsible for the content or security of those websites. These third party websites are not governed by this Privacy Policy, and we recommend you review the privacy policy of such website before submitting your personal information to such website.
